福建法治报—海峡法治在线11月8日讯 我们都知道“狗咬人”“狗挠人”很明显是侵权，那如果是“狗吓人”呢?如果是因宠物狗的吠叫声而受到惊吓不慎踉跄摔伤，狗主人是否需要承担赔偿责任?日前，厦门市翔安区人民法院审理了一起“非接触式”宠物侵权责任纠纷案件。不同于普通的犬类侵权纠纷中存在撕咬、抓挠、扑身等情形，这次“闯祸”的，是宠物狗的吠叫声。

案情再现

2023年4月，小晓(化名)未拴遛狗绳在某路段遛狗，小明(化名)和家人在该路段运动。小明跑步经过小晓旁边时，被小晓的狗追逐，小明因慌张而摔倒。

小明回家后感觉脚踝疼痛并开始肿胀，小明父母即带小明到医院就医。经检查诊断，小明“左踝、左足损伤，左侧胫骨远端骨折”。

“对方遛狗的时候没有拴绳，我的孩子跑步经过的时候，他的狗就追上来，孩子害怕狗追上来咬，为了躲避狗的追赶才摔倒受伤，对方应当承担责任。”经民警调解未果，小明遂向翔安区人民法院提起诉讼。

“是小孩自己摔倒的，与我无关。”小晓认为，自己的狗根本就没有咬人，也没有任何伤害到小明的行为，只是见有人跑过来以为小明是在和它玩所以追了上去。

法院审理

遛狗时未拴绳存在过错应担责

翔安区人民法院经审理认为，未对动物采取安全措施，造成他人损害，应当承担侵权责任。小明为了躲避小晓饲养的宠物狗的追逐而摔伤，其饲养的宠物虽未直接咬伤或者抓挠伤害小明，但是小晓遛狗时未拴绳存在过错，小明确系为了躲避小晓所饲养的宠物引发的险情而受伤，为此，宠物饲养人小晓应承担相应的侵权责任。故小明因此产生的合理经济损失应由小晓承担。

最终，法院判决小晓向小明支付医疗费、营养费和交通费等经济损失2000余元。

法官提醒

犬类致人损害，并非只局限于撕咬、抓挠等与人身体直接接触的行为，犬类靠近陌生人吠叫、闻嗅等行为也完全可能引起他人恐慌进而发生身心损害的后果。犬类的一些非攻击行为，如大声吠叫、奔跑等，虽然可能没有与受害人直接接触，但只要与受害人的损害结果构成因果关系，同样属于“饲养动物造成他人损害”，宠物饲养人要承担相应的责任。
